Claims of Copyright Infringement & Related Issues (17 USC § 512 et seq.)

Knwn Local, LLC respects the intellectual property rights of others and expects our clients and users to do the same. Anyone who believes their work has been reproduced in a way that constitutes copyright infringement may notify our designated agent by providing the following information:

Filing a Copyright Infringement Notice

To file a notice of copyright infringement with us, you must provide a written communication that includes the following elements:

Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
Identification of the infringing material that you claim needs to be removed, including a description of where it is located (such as the URL or specific location) so that we can locate it;
Your contact information, including your address, telephone number, and email address, so that we may contact you about your complaint;
A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement of accuracy that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf;
Your physical or electronic signature.

Our Response Process

Upon receiving a valid DMCA notice that complies with the requirements above, we will:
Promptly investigate the claim
Remove or disable access to the allegedly infringing material
Notify the client or user who posted the material
Take reasonable steps to contact the client or user

Please be aware that there are substantial penalties under federal law for knowingly making false claims.

Filing a Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. A valid counter-notification must include:

Your physical or electronic signature;
Identification of the material that has been removed or disabled and the location where the material appeared before removal;
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
Your name, address, and telephone number;
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., for any judicial district in which Knwn Local may be found);
A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Important Notes

Email notices: While you may send notice by email, we must receive your signed statement (either by mail or as a signed attachment to your email) before we are required to take action.
False claims: Please be aware that filing a false DMCA claim may result in liability for damages, including costs and attorneys' fees.
Legal advice: This information should not be construed as legal advice. We recommend you seek independent legal counsel before filing a notification or counter-notification.
Repeat infringers: In accordance with the DMCA and our Terms of Service, we will terminate the accounts of clients who are repeat infringers when appropriate.

Client Responsibilities

As part of our services, we remind our clients that they are responsible for:
Ensuring all content they provide or request us to create does not infringe on third-party copyrights
Obtaining proper licenses for any copyrighted materials used in their marketing campaigns
Complying with platform-specific copyright policies (YouTube, email providers, etc.)
